The EIB takes note of the European Ombudsman’s decision in a case brought by an Italian company in the matter of a public tender for the construction of a bridge in Bosnia and Herzegovina (178/2014/AN). The EIB works closely with the Ombudsman on all cases that concern it, and it cooperated fully with the Ombudsman on this case. In its decision, the Ombudsman refrained from making specific recommendations. Whilst the EIB considers that there was no error in its interpretation of the tender documents in this case, it will continue to cooperate with the Ombudsman and develop appropriate responses to all the relevant parts of the decision. The EIB agrees with the Ombudsman on the importance of strong, effective and transparent procurement mechanisms, and it will continue to keep its policies on procurement under review.
