    Case Description

    Complaint

    The complaint concerns a station of the “Cairo Metro Line 3 (Phase 3)” project in Egypt, financed by the European Investment Bank (EIB). The complainants are residents of a building adjacent to the station. The complainants allege that the station has changed design over the course of construction and that the current design will impact accessibility and safety of access & exit to their building’s garage.

    EIB-CM Action

    During the Initial Assessment, the EIB-CM identified three allegations: i) failure to identify and to minimize impacts on the building, ii) failure to assess the station design alternatives, iii) failure to consult with the residents on the change of design. The EIB-CM carried out a compliance review of these allegations regarding failure of the project to comply with the applicable environmental and social requirements in the context of potential EIB maladministration, whether the Bank complied with the applicable regulatory framework and with its obligations.

    Conclusion

    The EIB-CM performed its compliance review and found the allegations to be not grounded. It found that constraints of the design change were identified by the promoter and the impact on the garage accessibility partially mitigated as from the date of the complaint. However, the independent experts’ report, commissioned by the EIB-CM, identified there remained some public safety risk on the road and suggested a number of additional mitigation measures. Therefore, a few suggestions for improvements are proposed.
