Description

El protocolo de acuerdo entre el BEI y el Defensor del Pueblo Europeo tenía por objeto mejorar la protección de los interesados frente a una presunta mala administración relacionada con las actividades del Grupo BEI. El objetivo del protocolo de acuerdo era garantizar la eficiencia y la eficacia de las investigaciones del Defensor del Pueblo Europeo sobre posibles casos de mala administración, así como contribuir a que los interesados comprendieran adecuadamente la función del Defensor del Pueblo Europeo en el marco de las actividades del BEI.

El protocolo de acuerdo entre el Defensor del Pueblo Europeo y el Banco Europeo de Inversiones (BEI) estuvo vigente desde 2008 hasta 2023. El protocolo de acuerdo, firmado en 2008, tenía por objeto, entre otros, permitir a los no residentes de la Unión Europea afectados por las actividades del BEI recurrir al Defensor del Pueblo si fuera necesario. El protocolo de acuerdo también establecía formalmente las funciones y responsabilidades respectivas del Defensor del Pueblo y del BEI. La Defensora del Pueblo Europeo señala que ya no es necesaria esta aclaración formal entre las dos instituciones y ha asegurado al BEI que su oficina seguirá investigando las reclamaciones de personas que no sean ciudadanos o residentes de la Unión Europea cuando haya motivos para hacerlo. El procedimiento aplicado por el Defensor del Pueblo para la tramitación de reclamaciones en relación con el Banco se halla en consonancia con la manera en que la oficina tramita reclamaciones similares de otras instituciones, órganos, oficinas y agencias de la UE, también en el ámbito del acceso público a documentos, en el que los reclamantes pueden dirigirse al Defensor del Pueblo tras recibir una decisión confirmatoria, ya sea expresa o implícita.
