    Complaint

    On 19 December 2020, the EIB Complaints Mechanism (EIB-CM) received a complaint from a CSO with allegations of non-compliances of the project with the Italian and European environmental regulation.

    EIB-CM action

    On 18 November 2021, the EIB was informed of an application by the complainant to the EU Court of Justice for failure to reply to a Request for internal review of an administrative act under article 10 of the Aarhus Regulation (the letter of 19 December 2020). This new information drew the attention of the CM to the fact that by the email to the EIB-CM of 19 December 2020, the CSO did not intend to submit a complaint of maladministration to be handled in line with the EIB-CM Policy and Procedures. The letter to the CM appeared to be a Request for internal review of an administrative act in accordance with the Aarhus Regulation.

    Therefore, in line with 4.3.8 and 4.3.9 of the CM Policy, the complaint was closed and transferred to the EIB competent services.
