Case Description
Complaint
The complaint relates to the employment situation of a group of 52 workers employed by a member of the consortium contracted by the EIB promoter (the contractor) to conduct construction works for the Divaca-Koper Second Rail Track project in Slovenia.
Work performed
The Complaints Mechanism concluded its initial assessment during which the complainants, the contractor and the EIB promoter agreed to engage in a collaborative dispute resolution process to find mutually acceptable solutions to the issues raised in the complaint. While progress was achieved during the dispute resolution process, it did not lead to a full settlement agreement.
Outcome
The Complaints Mechanism decided to close the case with a recommendation for a specific EIB Group action, which is to formally request the promoter:
(i) to convey to the contractor the requirement to ensure payments of any outstanding amounts to the workers in line with applicable EU and national laws, and
(ii) to continue monitoring and reporting to the EIB on the progress and outcomes of the situation as part of its ongoing regular reporting obligations, to allow the Bank to document such information in its monitoring as required by the relevant EIB’s procedures.
