    Case Description

    Complaint

    In September 2015, the European Investment Bank’s Complaints Mechanism (EIB-CM) received a complaint raising several issues concerning the environmental impact assessment (EIA) and the financial sustainability of the proposed concentrating solar power project “EOS Green Energy” in Cyprus. The complainant requested confidentiality.

    The complainant made several allegations which concerned the project’s potential impacts on the environment and, particularly, upon bird life. Thus, the complainant took the view that the EIA was inadequate and that an Appropriate Assessment of such impacts should have been carried out in parallel with the EIA. Furthermore, the complainant challenged the analysis of cumulative impact originated by other large projects in the area which should have been taken into account in the analysis of the EIA. The complainant claimed that the project’s request for additional governmental subsidies may lead to a distortion of the market for renewable energies and to negative impacts for competitors. The complainant seeks to put the implementation of the project on hold, to carry out an Appropriate Assessment and for the Bank to refrain from funding the project.

    The documentation of the project was submitted to the EIB to be assessed under the European Commission’s NER300 Programme, a funding programme for innovative renewable energy as well as carbon capture and storage projects. In the context of the NER300 Programme, the EIB’s involvement is focused on the performance of certain tasks on behalf of the European Commission. Thus, the EIB performs an assessment of the financial and technical viability of projects, which includes environmental impacts.

    EIB-CM Action

    As the European Commission (EC) is responsible for relationship with third parties under the agreement of the NER 300 Programme, the EIB-CM and the EC agreed that the EIB-CM will issue a Conclusions Report which will be submitted for the consideration of the Commission which will subsequently prepare and send the final response to the complainant. The EIB-CM Conclusions Report was submitted to the European Commission for its consideration and for the preparation of the final reply to the complainant in March 2017. The EIB-CM proceeded to close this case after the EC submitted its final response to the complainant on 31st of July 2017.
